A fair election matters to every homeowner

Dear Homeowners,

We are concerned about the fairness and transparency of the upcoming board election and recall.

At the recent HOA meeting, manager Sam stated that the current board would win the next election. A statement like this raises concerns about management’s impartiality. Homeowners should decide the outcome through their votes.

There are also unanswered questions about the early sharing of nominee information and the safeguards surrounding an inspector selected by a board that includes members facing recall and seeking reelection.

These concerns do not establish election fraud. They do justify clear answers and an election process homeowners can independently observe.

We are calling for written confirmation of the inspector’s independence, secure ballot handling, access to the election rules and inspectable selection records, and clear arrangements for homeowners to witness the counting.

Please protect your vote: complete your own ballot, follow the official return instructions, and never sign a blank ballot or give anyone an unsealed ballot to complete. Keep election notices and report specific irregularities in writing directly to the inspector.

Please participate and attend the ballot count. Every homeowner deserves confidence that the results accurately reflect the votes cast, regardless of who wins.

Towing: were the required notices made?

California Vehicle Code § 22658(f) requires an association causing a private-property tow to notify the local traffic law enforcement agency within one hour after authorizing it. Section 22658(m) separately requires the towing company to notify local law enforcement after the vehicle is removed and in transit.

Residents have raised questions about whether these notifications were made for recent tows. We have not confirmed a violation. We are asking the association and towing company to provide the dates, times, and agency notified so homeowners can understand what happened.

If your vehicle was towed, ask local law enforcement whether the tow was reported and request a copy of the written tow authorization from the towing company. You can contact our group with questions. Please leave out license plates and other personal information when sharing documents.

Homeowners deserve clear information about the people and companies managing Briarcliffe. Sam (Sabawoon) Shewa is the manager identified in association communications, and HOA Solutions is the management company named in those communications. This independent group is collecting documents and questions so neighbors can review the information themselves.

Questions for the board and manager

  • What services and fees are in the association’s current management agreement?
  • What written disclosures were provided about any financial interests in vendors serving Briarcliffe, and when?
  • How were management and security vendors selected and approved?
  • Where can members inspect the executed contracts and written board approvals?

California Civil Code § 5375.5 addresses written disclosure of certain potential manager conflicts when presenting a service bid. Civil Code § 5200 includes specified contracts and board approvals among association records.

Why we are asking questions

Sam manages Briarcliffe, and Zoom Security Group provides security for the HOA. Sam has also been identified as a principal of Zoom Security Group. That overlap raises a potential conflict of interest. We ask the board to explain what was disclosed in writing and how the security contract was selected. California Civil Code § 5375.5 addresses disclosure of certain financial relationships when a manager presents a service bid.

A listing, complaint, or lawsuit does not by itself establish wrongdoing. If you have a relevant contract, filing, board notice, or correction to share, email the group. We will identify the source and update this section as documents are verified. Updated September 26, 2026.

Homeowner records

Know what you can request.

We believe the board and management should make it straightforward for homeowners to understand how association funds are spent and how decisions are made.

California law gives association members the right to inspect and copy specified association records, including financial statements, general ledgers, executed contracts, written board approvals, check registers, and non-executive-session meeting minutes. Access is subject to the law’s timeframes and lawful redactions. A member who properly requests records should receive access within the applicable deadline, without having to submit the same request repeatedly just to get a response.

Formal records request

Read the proposed request covering financial records, vendor contracts, projects, and board approvals from January 2024 onward. It is a request document, not records already obtained.

It includes your name, address, and signature and may be presented to the association to verify homeowner support as described in the form.
